1. How do I know if I have a claim?
In some cases, it will be easier to decide if you may have a valid claim. For instance, you may be in your car stationary at traffic lights and hit in the rear. Clearly this is the fault of the third party driver.
However, it is not always as simple as that. It may well be that you feel you were responsible for the accident and as such you never bother to find out for sure. You will be surprised to learn that you could be losing the opportunity to claim compensation. 2. What if I feel I am partly to blame?
Even if you are partly to blame for your accident, that does not prevent you from claiming. The only difference is that your claim will be reduced by the percentage you are to blame. For example if your claim is worth £10,000 and you are found to be 50% responsible, you will receive £5,000 in compensation. You will also recover all your legal costs as your case was successful.
3. How much will it cost me if I lose?

6. How long does the process take?
This depends on many factors. Firstly, your solicitor will write a Letter of Claim to the third party or parties setting out your claim and why the third party or parties should pay you compensation. This starts the claims process.
The Personal Injury Protocol must be followed and this allows the third party or parties and their insurers a period of almost 4 months from the Letter of Claim to investigate liability for the accident (i.e. to enable them to speak to any witnesses and obtain documents such as accident reports etc). This period is compulsory and so you may not see any real progress in the first few months of your claim.
In simpler cases, a decision on liability could be received within a matter of weeks.
Some of the factors that will determine how long your case will take are:
• The complexity of your case in relation to fault of the third party of parties
• The extent of your injuries (i.e. a claim is unlikely to settle if you are still suffering from the effects of the accident unless there is clear medical evidence as to the future of your symptoms)
• How quickly the third party or parties respond to correspondence
• How quickly you provide any further information to your solicitor
• Whether there are any other investigations needed
Some cases settle within a few months whilst others can take much longer but your appointed solicitor will advise you as your case progresses.
7. Will I be kept up to date?
Yes. Your appointed solicitor will write to you with an update at least every calendar month but will write to you as and when events occur and will also telephone you with information or to request information or clarify details with you. 8. Will I have to attend a medical examination?
Yes. Your appointed solicitor will obtain copies of your medical records but it will be necessary for you to be examined by a medical expert so that a medical report can be obtained on your injuries. This is necessary to support your claim for injury and your appointed solicitor will make all the arrangements and advise you of the medical appointment when the time comes.
9. Will I have to attend court?
Whilst there is a possibility that you will need to attend court to prove your case, you should be aware that less than 2% of these cases end up in court so the likelihood is remote. The court process is expensive to the losing party and no insurance company wants to waste money defending a case which should be settled.
